Non Molestation Order !!!!

He did nothing but ask his son to do his home work. He refused and stormed off and make a false call to the police the rest was history. Mum got involved took the mood out on her husband. You know when a 10 year old lad, ends up ringing the police its bad they take kids complains real. The social are not taking the kids away, if he returns home after the order has been discharged.

That sounds like you've been given a massively watered down version of events - a none molestation order wouldn't be given so lightly.

Does seem a bit fishy as the social services would do an investigation from the police reporting the incident and if it is due to a 10yr old not doing homework it wouldn't go to a judge the social services would only advise and put restrictions in place till the investigation is done. Plus the child would've got a stern warning from the police but we can only speculate
 
Its true what i said thanks. I have seen the paper work.
No one is saying its not TRUE!! just seems a bit strange due to a child not doing homework isn't exactly a police matter was you there when the event happend?

False, and plausible enough that the police haven't been able to pick holes in his story and have granted a nm order?

There's more to it than you're saying or than you're aware of. They don't grant these orders over an everyday family squabble.
 
I have read his reports it true what i am saying. You can get non molstation put on anyone if its true or not. The kids and wife said he try hitting them which was not true.
 
Reading between the lines:
Dad has argument with kid over homework.
Dad hits kid, and mum intervenes and she gets a slap too.

But also there could be previous occasions. As pupuqiop says, the OP might not be aware of everything thats occurred before. A court order isnt granted on order, there is a degree of investigation that has to happen.

Can Social seek a order on you, if this orders which ends in two weeks time. That person does not want to renew it.
 
Judge was wrong in law what mistakes can he make and if someone has liar to get non molestation order put on you with out, evidence but here say it was, what do u say thank you.

There's no such thing as hearsay in a NMO.
The social services have ONE objective and that is to protect the children.
Spouses and partners have a habit of splitting up and getting back together and no one cares, regardless of what anyone said against who.
If social thinks children may be at risk the order is practically impossible to lift.
No judge, magistrate or social worker or even social services administrator is going to be the one who intervenes because they all remember the cases of the past where the shit hit the fan, Victoria Climbie, Baby P and a few others where innocents were sent to live with psychopaths that ended up killing them, so they tend to be a bit more rigorous these days.
And they couldn't give a shit who has told fibs about ex girlfriends, ex husbands or anyone else.
They listen to what the children have to say.
No one gives a crap about wives/husbands fairytales who change their stories every half an hour.
 
The order runs out in few weeks they asking her to renew it and she at two minds over it. Nothing happened to kids in this. The mother needs to grow up little bit. He got evindence to clear his name so has he done right appealing.
 
It is clear that the court need to hold a hearing to determine if those allegations are true or not, and to consider whether the Non-Molestation Order continues to be justified and for how long. Just getting a feedback on this for a friend. Does this mean if the allegations are not true the non molestation order is ended ?

Non molestation order

the strongest ways you can protect yourself against domestic abuse is by taking out a non-molestation order against your abuser.

They are one type of an injunction, a term used to describe any court order served on someone forbidding specified behaviour, such as threatening you, or limiting their actions, like visiting your home.
A non-molestation order is typically issued to prohibit an abuser from using or threatening physical violence, intimidating, harassing, pestering or communicating with you. An order could prevent the abuser coming within a certain distance of you, your home address or even attending your place of work. It could also include your children in certain circumstances. An order will also prevent an abuser from instructing or encouraging others to do any of those actions.
A non-molestation order can protect you against behaviour that by itself may not be a criminal offence or in situations where the police have responded to a 999 call but then taken the view that there is insufficient evidence to charge your abuser with a criminal offence such as assault. If you have a non-molestation order in place, then the police can arrest your abuser for the offence of breaching that order.
To make an application for a non-molestation order, you and your abuser must have “association” under the Family Law Act 1996. This includes those who are or were: married, civil partners, living together or partners. It also includes relatives and in-laws along with those who have a child together.
When deciding if to grant an order, the court will consider all your circumstances, primarily the need to secure the health, safety and well-being of you and any children. Evidence of abusive text messages/emails along with photos of any injuries or damage to property will strengthen your case.
It is possible to make an emergency application for a non-molestation order if the incident has happened recently, as a guideline, within the past week unless there is a good reason for any delay. If an order is granted without notice, then there is a further hearing approximately 14 days later, to give your abuser the opportunity to tell the Court whether they oppose the order.
A non-molestation order is usually granted for six to 12 months, although in certain circumstances, it could be granted for a longer period. An order can also be extended.
A non-molestation order does not need a power of arrest as it is a specific criminal offence to breach
