I’ve never worn a face mask, and after reading this solicitor’s letter that was forwarded to a facebook friend, I’m awfully glad I haven’t. I do have health conditions, so I am medically exempt according to government guidelines. However, I have worn a face visor instead, not because I ever believed that offered any protection as I also believe face masks don’t, I just wear the visor to simply avoid potential conflict with supermarket managers. By the sounds of this letter though there's going to be a lot of legal cases, maybe end up like the payment protection claims scandal

Well, here’s that letter, what are your opinions on facemasks then? Do they protect you from Covid-19? Have you been informed of your individual health risks of wearing a face mask?

IMPORTANT MASK INFORMATION

The Government has FAILED to conduct a Risk Assessment of the risks to the individual members of the public for the harms caused to them by mask wearing- or wearing a face covering.

Without such a Risk Assessment, the individual is NOT providing “informed consent” to wear a “medical device” (which a mask is as defined under the Medical Devices Regulations 2002).

A face “covering” falls to be regulated under the Consumer Protection Regulations. The Face Coverings Regulations are therefore - prima facie - unlawful and should not be enforced.

In the view of our legal team, the Face Coverings Regulations are ultra vires the Government’s powers but that legal argument is ongoing.

None of the supermarkets are providing their customers with a Risk Assessment either - so their customers are also not able to provide their “informed consent” to wearing a face covering/mask. This is unlawful as “informed consent” must be obtained.

Anyone being asked to wear or use a medical device - such as a mask - should be medically assessed by an Occupational Health team for their INDIVIDUAL risk posed to them by wearing a mask. Failure to conduct a Health & Safety Risk assessment is both a civil and a potentially criminal offence. Therefore both the Government and the supermarkets - and anyone else enforcing mask mandates in the absence of a full Health & Safety Risk assessment in the workplace -, is acting unlawfully and can be held PERSONALLY liable for the damage caused to the individual.

Legal challenges are already being run against the “mask perpetrators” to challenge this unlawful and harmful mask mandate and cases are already being won, and damages for harm caused paid out.

I’m a specialist disability discrimination lawyer who also has a stream of claimants lining up to bring legal claims for damages from this mask mandate. Countless people are being harmed by wearing a mask and others are being harmed from the discrimination they are enduring from being mask exempt.

The flood of litigation is going to be Tsunami-like!!! Be warned: perpetrators will be held to account.
Anyone enforcing or imposing this mandate should be warned that they are acting unlawfully and will be held personally liable for the harm they cause.

I advise anyone harmed by this mask mandate in a work environment (which supermarkets are) to file a report of your harm to the Health & Safety team and ask them to conduct an investigation into whether the employer or supermarket or other “mask perpetrator “ has conducted a valid H&S Risk Assessment.

The local council’s Environmental Health Officer is responsible for ensuring that commercial premises in their area are safe for the public. This includes whether it’s safe for the public to be forced to wear a face covering or mask whilst in a supermarket or other commercial premises. Without a full Risk Assessment, no one should be required or forced to wear a face covering or mask - it’s a breach of the Health & Safety laws and a potentially criminal offence. If the employer or other “mask perpetrator “ hasn’t followed the law in forcing you to wear a mask, criminal investigations can follow under Health & Safety laws.

The Equality Act 2010 does not permit anyone to discriminate against a disabled person on the grounds of their disability. Refusing entry to a shop or access to public services to a disabled person is prima facie disability discrimination. No evidence can be lawfully demanded. It’s a breach of both the right to privacy and the Equality Act 2010 to ask for medical evidence in this manner.

Masks worn by the public in community settings, do not prevent transmission of a virus particle as tiny as SARS-CoV-2: that’s what the scientific research evidence shows. Masks can INCREASE the risk of transmission if not face-fitted and fit-tested for the individual wearer as leakage occurs.

Masks can INCREASE the risk of secondary bacterial and fungal infections due to incorrect putting on and taking off of the mask, incorrect storage and lack of sterilisation of the contamination collecting on the surfaces of the mask.
These contaminates are then inhaled: the moisture and humidity of the mask is a perfect breeding ground for bacteria and fungus which multiply in the mask fibres. These are then inhaled deeply into the lungs where they multiply further, along with the loose fibres of the mask which collect in the lungs.

Secondary bacterial lung infections are a major risk factor from inhaling bacteria into the lungs. Secondary bacterial lung infections were the major cause of death in the Spanish Flu. They had cloth mask mandates then too. See a correlation??

Masks cause multiple organ damage - some of which is irreparable and permanent.
Masks cause social, cognitive, emotional and psychological harm too.

Have YOU been fully informed of all the harms that wearing a mask causes to YOU??

Have YOU had a H&S Risk Assessment by an Occupational Health Team for the risks posed to you - as an individual- for mask wearing?? If not, how do YOU know what the risks are?? How are YOU providing YOUR individual informed consent to wearing this medical device without a full H&S Risk Assessment?? You’re not able to. You’re simply guessing that it won’t harm you in the absence of a full Risk Assessment.

you really need to get your facts correct,
facemasks do NOT, and NEVER have been claimed to stop the wearer catching Covid,
they are to help minimise the spread of Covid by the wearer,
thats why by not wearing one you are putting me, my family, and everyone else at greater risk,

No, I've never put anyone's life at risk, I don't have COVID-19, and never have had it.

try checking out the facts on how surgical grade fackmasks actually work,
quite different to the type of masks typically worn by construction industry (etc) people

I wear face masks as, do my family to minimise the, spread of the, virus but to keep others safe most of all.

Trust me I see people not bothering with face masks when entering shops. Nothing gets said to them either. So rules not being enforced in these places when they should be.

(1) the government guidlines don't stipulate medical grade face mask

(2) I know when I've got the flu, and I've always stayed at home, and that as far as I'm concerned the best way to avoid spread.

I wear face masks as, do my family to minimise the, spread of the, virus but to keep others safe most of all.

That said I can personally attest to the risks of wearing them.

I have to wear a mask 8 hours a day and have done 5 days a week since April.

For the first 6 months the masks we were given did not properly fit me.

The prolonged effect was huge. My jaw now dislocates when I open my mouth past a certain point, and I was on industrial strength pain relief simply to sleep. I was able to wear a visor for a few months a the pain disappeared.

I do still wear a mask in shops as it's a mild inconvenience in exchange for protecting others.

But people need to ensure masks are properly fitted if worn for prolonged periods.

This bug is not like anything we are used to,been at high risk i would need to wear a mask or shield if in presence of a few people and if doing shopping doing it at opening times when not crowded.

Face masks can be a curse moving and slipping down on ones face needing constant adjusting. I am ready for the next upgrade spread as of feb last year bought a full face respirator giving full face coverage.

I pity those who cannot wear a mask and might be more prone to getting an infection and possibly spreading it in a shop as not wearing one.

My question is why do they want to take the chance of been out there?

Most of us are staying at home in lockdown

I hope for everybody to stay safe.

They're all medically exempt.
I'm sure for those shops that haven't asked their customers to confirm this, have just properly accepted they're medically exempt in accordance to government guidelines.


Some shops are now declining to serve people without masks, exempt or not.

Wrapping a scarf loosely around your face is effective.

When dealing with exponential growth anything that dampens inputs can have a hugely positive effect on outcomes

If we have 65 iterations of a 1.3 increase than 1 becomes 25m

If that first iteration only multiplies by 1.2 and all other remain at 1.3 then 1 becomes 20m

A huge reduction. And only one person has reduced their risk of spreading




We don't need masks to be 100% or even 20% effective for the damping to be hugely positive

This crap will sink without trace and rightly so, it gets on my t!ts when idiotic parasitic lawyers try to wind up the permanently baffled of society by telling them they can win them a grand if someone farts near them at a bus stop.

As I've said above, I do hope you're right that it helps minimise spread to others, but I'm picking up a study done in Denmark where its been proven not to be the case..still looking into it though, so wee bity early to shout out about it.

Yeah, I've always suspected this, and didn't think a home made cloth mask suggested by the government was anything comparable to a medical grade approved mask
of which I would assume fits properly. That's why I always considered the face visor I chose to wear instead would be completely useless, because of all the gaps but remember the government
suggested this for shop counter assistants in the beginning. It's only recently I've discovered on the Scottish Government's website that the visor has to be worn with a face mask (changed inlate August).

The biggest problem with face masks is that they have time life, so for example the blue surgical masks will last around 4 hours then they should be disposed of, i know people wearing the same masks for weeks, they no longer protect so its important to make sure you change your masks, if everyone wore masks it would help stop the spread of covid 19. The kn95 make and blue surgical masks are the best but as I said, people will wear the same one weeks on end, mayswell not bother, but yes masks will help stop the spread of covid.

There is no doubt wearing masks is uncomfortable. But wearing one outweights the risks with not wearing one.

Its about safety first, if people have the mindset "I am fit and healthy and wont catch covid so why bother wearing a mask" then this virus spread will never be brought down. Plus other people would be put in danger also.

Making sense of the research on COVID-19 and masks

There is clear evidence that face coverings reduce the spray of droplets produced during speaking, coughing, and sneezing6,17,19,49–52. This is why masks have long been recommended for individuals with respiratory infections7,7,40,53–55. Furthermore, home-made cloth masks are similar in effectiveness to surgical masks in diffusing the “jets” of droplets that could spread COVID-19 (for details on mask types, see Figure 1 and the “deep dive”)6,19. For example, one of the most definitive studies on viruses and face masks found a 90% reduction in influenza viruses after breathing through a mask and a complete removal of coronaviruses50. However, not all face coverings are equally effective. Multi-layer synthetic and cotton masks provide the most filtration, while bandanas and fleeces (neck gaiters) provide very little or no protection6,20. Because only fitted respirators (the finest-meshed masks) provide reliable protection from external droplets and viral particles41,53,56, public masking works through “source control,”15 where “my mask protects you, and your mask protects me.”50

While it is always difficult to establish cause and effect at the community level, there is now strong evidence that public masking can slow or even stop the spread COVID-19 in states and countries4,7,11,13,16,44,57. One of the most conclusive studies on the subject compared the effectiveness of universal masking in the health-care system of Massachusetts8. This large study involved 75,000 participants, including healthcare workers and patients. Of all the public health interventions, universal masking appears to be the most associated with stopping the exponential growth of COVID-19 cases, first flattening and then decreasing the infection rate8. Another study from Missouri demonstrated the effectiveness of universal masking in commercial settings9. Two hair stylists contracted COVID-19 but continued to work for 10 days, servicing 139 clients. Similar accounts are being reported from around the U.S. and the world13,16,58,59, supported by quantitative simulations60 and randomized controlled trials from other diseases7.
As I showed above masks do not need to be anywhere close to even 30% effective to be one of biggest weapons against the spread of covid.

Thought experiment: say masks were shown to be0% effective. What do you think lockdown rules and enforcement would look like with vaccine being administered?

That is 100% correct, masks DO NOT stop the wearer catching covid 19, they HELP stop and slow the spread

Just to add I was very fit and healthy and don't know how I got it.

I can categorically state that's a load of rubbish,
I've just spent almost all of last year working in Denmark, I went at the beginning of March before they locked down solid for 9weeks,
and regularly speak to my Danish friends,
You cannot even stand at a bus stop without wearing a mask,
Masks are mandatory in all public spaces.
You will be refused entry to any building, shop etc without a mask, public transport, taxis, everywhere.
This has been since they started opening in May.
 
It pisses me off when I read shit like this,

No matter how much you explain the dangers of the virus and how it can seriously screw your life up they still wont buy it.

Excuses I have seen for not a wearing a mask online and speaking to few people is sad and pathetic and they have no medical reason either for why these say they wouldnt wear a mask.

I understand if people can't wear a mask for medical reasons but I'm sorry, you can buy a face visor online for 5 quid!!
